Welcome to FitSupplyLab. These Terms of Service (“Terms”, “Agreement”) govern your access to and use of the FitSupplyLab website and any related products, services, content, features, or tools (collectively, the “Services”).

The terms “we,” “us,” and “our” refer to Coremotion Holdings LLC, a United States limited liability company, doing business as FitSupplyLab (“FitSupplyLab”).

FitSupplyLab is powered by Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

By visiting our website, browsing, purchasing, or otherwise using the Services, you explicitly agree to be bound by these Terms, our Privacy Policy, and our Returns, Refunds & Shipping Policy. If you do not agree, you may not access or use the Services.

ARTICLE 1 – ELIGIBILITY & ACCOUNT RESPONSIBILITY

By using the Services, you confirm that:

  • You are at least the age of majority in your jurisdiction, or you have obtained explicit permission from a parent or legal guardian.

  • You agree to provide accurate, complete, and current information when making a purchase or creating an account.

  • You are entirely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

  • You may not transfer, sell, or assign your account to another party.

ARTICLE 2 – PRODUCTS & SERVICES

We make every reasonable effort to display our products as accurately as possible. However:

  • Product images, colors, and physical appearance may vary depending on your device's screen settings.

  • We do not guarantee that product descriptions or materials will perfectly meet your personal expectations.

  • HEALTH & SAFETY WARNING: Electrical Muscle Stimulation (EMS) is a physical muscle activation tool. Our EMS products are not intended for use by individuals with pacemakers, severe heart conditions, neurological disorders, or during pregnancy. You are contractually required to consult a physician or your doctor before starting use.

All products are subject to availability and may be modified, updated, or discontinued at any time without prior notice. We reserve the right to limit quantities, refuse service, or restrict sales to any person or geographic region at our sole discretion.

ARTICLE 3 – ORDERS & ACCEPTANCE

  • Fulfillment Automation: Placing an order constitutes an offer to purchase. Because our order processing and logistics routing are fully automated to ensure fast delivery times, orders cannot be canceled, modified, or intercepted once payment is successfully completed.

  • Order Acceptance: An order is not legally accepted until payment is successfully processed and a confirmation email is issued.

  • Right to Cancel: We reserve the right to cancel or refuse any order at our sole discretion for any reason, including suspected fraud, unauthorized billing profiles, or clear pricing errors. If your order is canceled, you will be notified via the email address provided at checkout.

ARTICLE 4 – PRICING, PAYMENTS & BILLING

All prices are listed in the applicable currency shown at checkout and may change without notice. You explicitly agree that:

  • All billing, cardholder, and contact information provided is 100% accurate.

  • You are fully authorized to use the designated payment method.

  • You will pay all outstanding charges incurred, including local taxes or import processing fees if applicable.

ARTICLE 5 – SHIPPING & DELIVERY

  • Standard Timelines: Delivery windows (standardly 5 to 9 business days) are operational estimates based on carrier statistics and are not absolute guarantees.

  • Fulfillment & Loss: Delivery is contractually deemed complete when the designated third-party postal carrier (e.g., PostNL, DHL, or regional equivalents) logs the shipment tracking status as "Delivered" to the address zip code provided at checkout. FitSupplyLab is not liable for packages stolen, lost, or misplaced after an official carrier delivery confirmation has been logged.

  • Transit Delays: We are not responsible for minor operational transit delays caused directly by shipping carriers, customs clearance delays, or force majeure events outside our direct corporate control.

ARTICLE 6 – RETURNS & REFUNDS

All returns, exchanges, store credits, and refunds are strictly governed by our standalone Returns, Refunds & Shipping Policy, which is fully incorporated into these Terms. By accepting these Terms, you acknowledge that you have reviewed and accepted our return procedures.

ARTICLE 7 – INTELLECTUAL PROPERTY

All content displayed on the Services — including logos, trademarks, branding assets, texts, product graphics, videos, code, and custom designs — is strictly owned by or licensed to Coremotion Holdings LLC, doing business as FitSupplyLab, and is protected by international intellectual property laws. You may not copy, reproduce, distribute, reverse-engineer, or exploit any content without prior written permission from our corporate office.

ARTICLE 8 – THIRD-PARTY TOOLS & LINKS

We may provide operational access to third-party tools or web links (such as order tracking apps). We do not control, monitor, or maintain responsibility for third-party content, platform services, or external privacy policies. Use of any third-party services is executed entirely at your own risk.

ARTICLE 9 – SHOPIFY PLATFORM DISCLAIMER

FitSupplyLab is hosted securely on the Shopify Inc. architecture. All sales, merchant liabilities, and customer service obligations are strictly between you and FitSupplyLab directly. Shopify Inc. is not responsible or liable for any operational aspect of sales, logistics fulfillment, or localized customer service, and you release Shopify from any related claims.

ARTICLE 10 – PRIVACY

Your submission of personal information through the storefront is governed strictly by our comprehensive Privacy Policy, which forms a binding part of this Agreement.

ARTICLE 11 – USER FEEDBACK & REVIEWS

By submitting product reviews, feedback, or marketing suggestions on our platform, you grant FitSupplyLab an unrestricted, worldwide, royalty-free, perpetual license to use, edit, and publish such content for promotional or operational purposes.

FitSupplyLab does not claim or guarantee that user reviews represent typical, guaranteed, or everyday physical results. Individual fitness outcomes from using our EMS products will vary depending on body composition, consistency of training, diet, and adherence to a healthy lifestyle. Reviews reflect the personal opinions of individual users and must never be interpreted as medical advice. We reserve the right, but hold no obligation, to remove user submissions that make unsubstantiated medical claims or violate third-party rights.

ARTICLE 12 – ERRORS & CORRECTIONS

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, shipping charges, or transit times. We reserve the right to correct any errors and to update information or cancel affected orders at any time without prior notice (including after you have submitted your order).

ARTICLE 13 – PROHIBITED USES

You are strictly prohibited from using the Services or its content for:

  • Any unlawful, fraudulent, or deceptive commercial activities.

  • Misrepresenting your identity, billing data, or location during checkout.

  • Harassing, abusing, or discriminating against our support staff.

  • Uploading malicious code, viruses, or scraping automated store data.

  • Filing bad-faith financial disputes (friendly fraud) before allowing our internal customer support team to review order fulfillment logs.

Violation of these terms will result in the immediate termination of your access to our Services and permanent blocklists from future purchasing.

ARTICLE 14 – TERMINATION

We reserve the right to suspend, restrict, or terminate your access to our website or Services at any time without notice if you violate any provision of these Terms. You remain fully liable for all charges incurred up to the date of termination.

ARTICLE 15 – DISCLAIMER OF WARRANTIES

Our Services and products are provided on an “as is” and “as available” basis for your personal consumer use, without warranties of any kind, express or implied (including implied warranties of merchantability or fitness for a particular purpose). We do not guarantee uninterrupted, error-free, or completely secure operation of our online storefront.

ARTICLE 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, FitSupplyLab, its owners, directors, or affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of our products. Our total corporate liability to you for any claim arising out of a purchase shall not exceed the actual purchase price paid to FitSupplyLab for the specific product in question.

ARTICLE 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FitSupplyLab, Coremotion Holdings LLC, its parent entities, owners, and partners from any third-party claims, legal fees, or demands arising out of your violation of these Terms or your misuse of our products.

ARTICLE 18 – SEVERABILITY

In the event that any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity of the remaining provisions.

ARTICLE 19 – ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and Shipping & Returns Policy, constitute the complete and entire legal agreement between you and FitSupplyLab, completely superseding any prior verbal or written agreements.

ARTICLE 20 – GOVERNING LAW

These Terms and your purchase contracts shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict-of-law principles. Any formal legal disputes arising from your interactions with our Services shall be resolved exclusively in the state or federal courts located in California, unless otherwise explicitly dictated by mandatory regional consumer protection laws.
